Terms & Conditions

1. Definitions

  • "Service" refers to the senior care accommodations and programs provided by Lanna Haven
  • "Resident" means the senior individual receiving care services
  • "Family" or "Representative" refers to the person legally authorized to make decisions for the Resident
  • "We," "Us," "Our" refers to Lanna Haven
  • "Agreement" means these Terms & Conditions and any service-specific contracts

2. Acceptance of Terms

By engaging our services, submitting an inquiry, or visiting our premises, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

The Resident or their legal representative must be 18 years or older and have the legal capacity to enter into this agreement.

3. Services Provided

3.1 Service Description

Lanna Haven offers three types of senior care services:

  • Community Living Residence: Full-time residential accommodation with month-to-month arrangement
  • Respite and Short-Term Stays: Temporary care ranging from one week to three months
  • Seasonal Wellness Retreat: Structured three-month enrichment programs

3.2 Service Scope

Our services include accommodation, meals, activities, and companionship. We are not a medical facility and do not provide medical treatment, nursing care, or specialized dementia care. Residents requiring medical attention will be assisted in coordinating with local healthcare providers.

4. Admission Requirements

4.1 Eligibility

Residents must:

  • Be able to perform basic daily activities independently or with minimal assistance
  • Not require constant medical supervision or specialized nursing care
  • Be able to participate in communal living respectfully
  • Provide complete and accurate health information during intake

4.2 Assessment

We conduct an assessment during the application process to determine if our services meet the prospective resident's needs. We reserve the right to decline admission if we cannot appropriately support the individual's requirements.

5. Payment Terms

5.1 Fees and Pricing

Current service fees are:

  • Community Living Residence: ฿16,500 per month
  • Respite and Short-Term Stays: ฿5,200 per week
  • Seasonal Wellness Retreat: ฿68,000 per three-month cycle

5.2 Payment Schedule

Payment is due in advance:

  • Monthly fees due on the first day of each month
  • Weekly fees due prior to the start of each week
  • Retreat fees due upon enrollment confirmation

5.3 Late Payment

Payments not received within 7 days of the due date may result in service suspension until account is current. We reserve the right to terminate service for accounts more than 30 days overdue.

5.4 Refund Policy

Monthly fees are non-refundable once the month has begun. For early departure with proper notice, prorated refunds may be considered on a case-by-case basis.

6. Termination

6.1 Termination by Resident or Family

Either party may terminate service with one month's written notice. Notice should be provided by the first day of the month for termination at month-end.

6.2 Termination by Lanna Haven

We reserve the right to terminate services immediately if:

  • Resident's care needs exceed our capabilities
  • Resident's behavior poses safety risks to themselves or others
  • Payment obligations are not met
  • False information was provided during application

7. Resident Responsibilities

Residents and their representatives agree to:

  • Provide accurate and complete health information
  • Report changes in health status promptly
  • Respect other residents, staff, and property
  • Follow reasonable house rules and safety guidelines
  • Maintain appropriate personal hygiene and care
  • Keep family contact information current

8. Our Responsibilities

Lanna Haven commits to:

  • Provide services as described in our service agreements
  • Maintain a safe and comfortable environment
  • Respect residents' dignity and personal preferences
  • Communicate regularly with families about resident well-being
  • Protect personal information in accordance with our Privacy Policy
  • Maintain appropriate staff presence and training

9. Limitation of Liability

While we take reasonable care to ensure resident safety and well-being, Lanna Haven is not liable for:

  • Medical conditions or health changes not disclosed during intake
  • Personal property loss or damage (residents should maintain appropriate insurance)
  • Injuries resulting from resident's own actions or pre-existing conditions
  • Circumstances beyond our reasonable control (force majeure)

Our total liability under this agreement shall not exceed the fees paid for services in the preceding three months.

10. Dispute Resolution

10.1 Informal Resolution

We encourage open communication. If concerns arise, please contact us directly so we can work toward a resolution.

10.2 Governing Law

This agreement is governed by the laws of Thailand. Any disputes shall be subject to the jurisdiction of Thai courts in Chiang Mai province.

11. Changes to Terms

We reserve the right to modify these Terms & Conditions with 30 days' written notice to current residents and families. Continued use of services after notice period constitutes acceptance of revised terms. Fee changes require 60 days' advance notice.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
